Foreign Early Warning Project

    A Beijing research institute developed a new device with significant market prospects. The device reduces resource consumption, increases material energy use, decreases dust and waste emissions, promotes energy saving materials and clean production, provides technical support to enhance traditional technologies in the automotive, marine and construction machinery and other industries and fields.

    Kangxin received a request from the research institute to develop a patent early warning strategy for the new technology to enter the German market to reveal the intellectual property risk in this technical field, to innovate patents and to expand the competitive advantage of the institute in the market.

Targeting the new device, Kangxin set up a team of lawyers and technical specialists which drafted a thorough project plan. The plan targeted key components and technologies to determine expected goals.

    Principal threats in the German market were expected to lie in the German and European patents. Therefore, to ensure complete collection of related German-language patent and intellectual property risk literature, Kangxin dispatched an outstanding expert team of litigators with German language skills to conduct the entire process of intelligence gathering and analysis.

    At the same time, we conducted a search, data cleaning and a supplementary search for each of the targets mentioned above, accurately screening thousands of documents of patent data. We separated our analysis in the following categories - infringement risk, competitors, technology distribution, technology development trends, and by technology’s focal points.

    project was implemented in collaboration with foreign law firms to form professional intellectual property legal opinions, including opinions on infringement judgment, infringement countermeasures, existing technology countervailing strategies, invalid evidence strategies and circumvention strategies. Throughout the project implementation process, we provided constructive criticism and ideas for future R&D and patent development. By understanding the gaps in technology, design around, and advantages and disadvantages of competitors, supplemented by a variety of patent mining methods, all resulting in a large number of patents, we were able to promote the formation of proprietary intellectual property patent layout strategy. From the market structure perspective, we were able to determine differences in the client’s and their competitors’ services and equipment, as well as differentiating qualities in the client’s technology and establishing its own advantages to gain a competitive edge over its competitors.

    This project has been unanimously positively assessed by an expert group and was determined to have helped make a significant contribution to the client’s risk identification and avoidance process, as well as having provided technical guidance, especially in terms of patent layout.
