Documents required in Administrative Litigation Cases for Korean Applicants (Practical tips!!)

In previous articles, I discussed the relevant documents and materials required by Chinese individuals and companies in administrative litigation cases and the corresponding signing requirement.  In this article, I will introduce the relevant documents required by applicants from South Korea in administrative litigation cases.

 

The relevant applicant introduced in this chapter is foreign applicant, and the documents required are different from those for domestic applicants.  The biggest difference is that the documents submitted by foreign applicants need to be notarized at the local notary office, and then legalized by the local Chinese consulate.  What specific documents are then required?  Please look at it in details below.

 

Individual applicant

 

1. Original notarized and legalized power of attorney signed by the applicant

2. Original notarized and legalized applicant's passport

3. Original official decision document and envelope issued by the National Intellectual Property Administration, PRC

4. One lawyer's letter stamped by the law firm

5. A copy of the lawyer's certificate of the attorney

 

Corporate applicant

 

1. Original notarized and legalized Power of Attorney stamped with the company chop

2. Original notarized and legalized copy of the company’s business license

3. Original notarized and legalized Certified of Authorized Representative stamped with the company

4. Original notarized and legalized company's chop record

5. Original official decision document and envelope issued by the National Intellectual Property Administration, PRC

6. One lawyer's letter stamped by the law firm

7. A copy of the lawyer’s certificate of the attorney

 

Regarding the above-mentioned relevant documents submitted by the corporate applicants, in the notarized document of business license, it should mention the information on it is "the same as the filing information of the company registry" or similar descriptions.  The applicant needs to remind the notary public to add such notary words when notarizing the documents, so as to facilitate the court's review.
