Protecting intellectual property is protecting innovation. On July 30, the Regulations of Fujian Province on the Protection and Promotion of Intellectual Property Rights were passed at the 17th meeting of the Standing Committee of the 14th Fujian Provincial People's Congress and will take effect on October 1.
The regulations aim to enhance the overall effectiveness of IP protection and promotion in Fujian by establishing a legislative framework that facilitates efficient promotion, robust protection, scientific management, and optimized services in areas such as IP commercialization, administrative and judicial protection, social protection, and service management.
Intellectual property is a bridge and link between scientific innovation and high-quality economic development.
To promote IP commercialization in Fujian, the regulations encourage open licensing of patents with market potential, foster deep integration between intellectual property and industrial development, and support the cultivation of high-value patents that benefit key areas and major industries.
To strengthen IP protection, the regulations stipulate that provincial-level market supervision and IP departments may lawfully delegate authority to eligible departments in municipalities to impose administrative penalties for patent agency violations. Enterprises, universities, research institutions, and third-party service agencies are permitted by law to form IP alliances to jointly defend against IP risks through mechanisms such as coordinated enforcement and shared infringement clue databases.
The regulations also establish a system for technical investigators in IP cases, including the creation of a technical expert database, helping to address the current shortage of technical expertise in IP law enforcement and judicial proceedings.
In terms of services and management, the regulations support universities, research institutions, libraries, and other organizations in opening their IP information services to the public.
They also encourage and support IP service agencies in participating in high-value IP cultivation and providing specialized services to SMEs and various innovation entities.
Moreover, the regulations encourage and support Taiwan compatriots in taking the patent attorney qualification exam and practicing in the field. Through platforms such as the Fujian–Taiwan IP Alliance, they aim to promote cross-strait IP industry project alignment, talent exchange, and collaborative protection.
