Huami sues Shenzhen smartwatch maker in US for patent and trademark infringement

    On August 23, Anhui Huami Information Technology Co., Ltd., along with its U.S. smartwatch brand ZEPP, filed a lawsuit in the U.S. District Court for the Central District of California. The lawsuit accuses Shenzhen Cospet Technology Co., Ltd. and its affiliated companies of patent and trademark infringement, as well as unfair competition. Huami claims that Cospet has infringed on its U.S. patent US9,729,693, which was filed in 2016, through the production of the "AMAZTIM" and "KOSPET" models. Additionally, Huami alleges that its registered trademark "AMAZFIT" has been infringed, resulting in consumer confusion. The company also accuses the defendants of false designation of origin and unfair competition. This lawsuit marks Huami’s first proactive legal action against a Chinese company in the U.S., as the company seeks to protect its legitimate rights and interests in the U.S. market, where it has previously faced patent lawsuits from U.S. non-practicing entities.
