Our client Hong Kong Lotte International Group found that there is a kind of chewing gum circulating in the market with its package indicating "manufactured under supervision of Hong Kong Lotte International Group" and its appearance being very similar with the client’s chewing gum. We conducted investigation on the infringing goods, collected evidences, and filed the civil suit representing the client against the manufacturer, the seller and the company "Hong Kong Lotte International Group Co., Ltd" for unfair competition.

The first instance judgment ruled that the behaviour of Hong Kong Lotte International Group Co., Ltd entrusted the manufacturer to manufacture goods with similar package and indicate "manufactured under supervision of Hong Kong Lotte International Group" infringed on the good will of the right holder and will cause confusion of the consumers, so unfair competition was established. The three defendants were demanded to stop infringing behaviour and pay damages.
